Terms and Conditions
§1. scope of application of the AGB
All services of Santa Claus GmbH are based on the following terms and conditions.
§2. lights: General
Our offers and agreements are based on the following conditions. The customer accepts our terms and conditions without restriction by placing an order or accepting the goods.
Should any provision of this contract be contestable, invalid or void, the contract shall remain valid in all other parts and provisions.
§3. lighting: Idea
The lighting idea for a new project is the intellectual property of Santa Claus GmbH. Regardless of whether it comes to an order or not, it remains the property of the company and can be reused at any time, unless exclusivity has been agreed in advance.
§4. lighting: Prices
The price quoted in the offer is in Swiss francs exclusive of VAT.
The price of the offer is based on years of experience.
The price of the offer may differ from the price of the actual invoice due to the estimated working hours, which cannot always be correctly predicted.
§5. glass ornaments and figures: General

The idea for the glass ornaments and figures is the intellectual property of Santa Claus GmbH. Regardless of whether it comes to an order or not, it remains the property of the company and can be reused at any time, unless exclusivity has been agreed in advance.
§7. glass ornaments and figures: prices
Online orders are only shipped against prepayment.
The prices quoted by us are unit prices and are net prices, i.e. without cash discount or other deductions and exclusive of VAT. Any additional costs (customs, etc.) shall be borne by the customer.
The prices on the webshop are guide prices, the Santa Claus GmbH reserves itself a possible price change.
In case of obvious errors in the prices in the webshop, Santa Claus GmbH can withdraw unilaterally from the purchase contract.
§8. glass ornaments and figures: dispatch
The ordered glass ornaments and figures are brought to the post office by Santa Claus GmbH and shipped by Swiss Post. Oral or written promises of delivery dates and delivery periods are to be understood as approximate. They take place under the reservation of correct and punctual self-supply by our suppliers. The customer is obliged to accept partial deliveries. If agreed delivery dates are exceeded, the seller is entitled to set a grace period of 14 days.
For deliveries within Switzerland and abroad, the costs incurred per parcel will be calculated according to the current official price list of the Swiss Post plus the costs for customs clearance.
§9. glass ornaments and figures: complaints
The customer undertakes to inspect the goods immediately upon receipt for obvious defects. Defects found must be reported in writing and specified immediately, but no later than 14 days after receipt.
§10. glass ornaments and figures: return shipment
Return deliveries will only be accepted by us after prior agreement. Return deliveries of goods taken from the original packaging will not be refunded by us. The customer undertakes to indicate his address and a reason for the return delivery clearly visible on the package. In the case of returns of goods, which we reserve from case to case, we are entitled to charge a processing fee of 5% after successful return. The costs of returning the goods shall be borne by the customer.
§11. glass ornaments and figures: retention of title
The purchased items shall remain our property until all claims including interest have been paid in full.
If the reserved goods delivered by us are to be treated or processed by our customers, it is agreed that the treatment and processing shall be carried out for us and that we shall thus be deemed to be the manufacturer. The customer assigns to us his claims from the resale of our reserved goods as security for all claims to which we are entitled against the customer at the time of the resale. We shall be entitled and our customer shall, at our request, be obliged to notify our customers' customers of the assignment of claims which has been made.

§12. glass ornaments and figures: resale
The customer is obliged to provide us with the information necessary to assert our rights against his customers, in particular to name the customers and hand over the documents.
In the event of default in payment or any other deterioration in the customer's financial circumstances, we shall be entitled to demand advance payments for orders not yet fulfilled.
The customer must inform us immediately of any measures taken by third parties, e.g. compulsory execution against the reserved goods or claims assigned in advance, and provide us with the relevant documents. Any costs of interventions shall be borne by the customer.
§13. place of jurisdiction
Place of performance for all mutual claims is our company headquarters in Arlesheim / BL. The place of jurisdiction shall also be Arlesheim / BL, unless otherwise prescribed by law.
